Position Summary:
The Director, Export Controls is responsible
for establishing and implementing University-wide export compliance policies,
procedures, and guidelines to comply with the U.S. export controls regulations,
including the EAR, ITAR, and FACR. The Director, Export Controls will also be
responsible for certain operational aspects of the ECMP. In addition, the Director,
Export Controls will have the opportunity to lead the
implementation and day-to-day operations of the University Export Controls
Compliance Management Program (ECMP), while helping to propel the University
forward as a national leader in responsible and ethical research.

The Director, Export Controls
will drive a synergetic approach to export control compliance such that NJIT continues to
seek out the best talent worldwide and leverage meaningful international
collaborations, while fully complying with federal export controls regulations
in NJIT's operations. The Director, Export Controls will be expected to
proactively foster collaborative relationships with stakeholders and
constituents across NJIT, and work with faculty, staff, and senior
administration to establish compliance policies and guidelines and implement
and operationalize procedures that effectively and efficiently support the NJIT's
operations.

Essential Functions:
-Builds and improves export compliance programs and policies. Identify and work closely with multiple stakeholders across the University.
-Manages the University-wide export control compliance program; evaluates and updates policies and procedures as necessary; and monitors, advises, and provides recommendations on addressing best practices, emerging trends, initiatives, and regulatory changes from the federal government.
-Oversees the University's restricted party screening IT system and process. Responsible for training "level 1" screeners (including but not limited to faculty, department staff, HR, Procurement, and OGI). Serve as the "level 2" screener and approver. Provides training to level 1 users based on the University procedures.
-Leads business processes relating to export controls project assessments, government registrations, technology control plans, government licenses, and all other export-related tasks and workflows.
-Provides guidance and support to stakeholders and the related export controls screening processes they lead.
-Identifies areas of improvement regarding the proper handling of export-controlled technology, software, and tangible goods. As needed, classifies goods, technology, and software in advance of any desired export or deemed export to foreign persons in the U.S.
-Work collaboratively with the Office of General Counsel on confidential export control matters including litigation, investigations, audits, and information requests.

Prerequisite Qualifications:
-Bachelor's degree and eight to ten years of related experience are required; a master's degree in related field or Juris Doctor is preferred.
-A track record of building export controls compliance awareness into the day-to-day activities of a large, complex, and multi-faceted organization.
-Experience in compliance with ITAR, EAR, and OFAC regulations.
-Demonstrated ability to integrate vision, strategy, tactics, and activities to move the University's mission forward.
-A willingness to be innovative and proactive, particularly around identifying emerging trends and concerns. A demonstrated ability to foster collaboration between faculty, staff, and administrators across several departments and offices.
-Demonstrated experience exercising considerable judgment and resourcefulness.
-Highly developed communication and interpersonal skills with the ability to influence through personal credibility, integrity, transparency, and professionalism.
-Strong customer focus and responsiveness to service standards and operational demands.
-Ability to effectively plan and execute multiple concurrent initiatives.

-At the university's discretion, the education and experience prerequisites may be exempted where the candidate can demonstrate to the satisfaction of the university, an equivalent combination of education and experience specifically preparing the candidate for success in the position.

Salary Information:
In compliance with the NJ Pay Transparency Law, the annual salary range for this position is $150,000-$160,000 (USD). NJIT considers factors such as (but not limited to) scope and responsibilities of the position, candidate's work experience, education/training, key skills, internal peer equity, as well as, market and organizational considerations when extending an offer. This pay range represents base pay only and excludes any additional items such as incentives, bonuses or other items.

Additional Information:
The
responsibilities of this position may include direct and/or indirect physical
or logical access to information or technologies subjected to U.S. Export Control Laws and Regulations (Export Controls).
Both Export Control and U.S. Department of
Defense contracts and sub-contracts impose certain restrictions on entities and
their ability to share export-controlled and other
technology and services with certain "non-U.S. persons" (persons who
are neither U.S. citizens, nationals, lawful permanent residents, refugees, or
asylees) or, in the case of classified information, non-U.S. citizens.

To comply with these laws, and in conjunction
with the review of candidates for those positions within NJIT that may present
access to export controlled technical data,
NJIT must assess a candidate's U.S. person status. The questions posed in the
